The US Mark – Is it worth the effort to join?
The US market is a high-priced and very large market with over 340 million inhabitants, making it more attractive than any other market. The legal framework and transaction security are right. There is still real money to be made in the US – despite the current trade disputes, the US market is currently growing.
In light of these circumstances, it is particularly worthwhile for medium-sized companies from Germany, Austria, and Switzerland to become active in the United States. Products manufactured in Europe could be sold there at four or five times the price, as is the case in Germany.
Why aren’t more companies from Germany, Austria, and Switzerland in the US?
It is often a combination of fear and ignorance, a lack of language skills, and not knowing how to be successful in the US as a German SME.
The following section provides brief information on how to solve these problems.
What are the first steps for a successful market entry in the USA?
A&O – The account for your business
We always recommend that our clients first open an account in the USA. This is because many procedures for further registration for companies, etc., require such an account. Unfortunately, it is also very difficult for German citizens to open an account in the USA.
Experienced consultants who have worked on many projects with individual bank employees often help here. The US bank then trusts that the German consultant will only bring in reputable clients.
Not all consulting is the same – German consultants can also help in the USA
Many shy away from entering the US market precisely because of the high consulting fees that are charged, especially by US firms. In doing so, we repeatedly forget that there are also German lawyers who are fully licensed to practice law in the US, such as the undersigned.
For example, as a German company, you could cooperate with a German lawyer based in Germany. As a law firm, we resolve complex cases from the USA in Germany on a daily basis.
A worst-case scenario occurs – how do I get out of the USA safely?
Many of our clients are afraid that, for whatever reason, their US venture will not work out. Solutions are already being sought for this “worst case scenario,” even though the project has not even started yet. In our experience, insolvencies in the US can be settled much more quickly than is the case in Germany, for example.
All Chapter 11 proceedings should play a pioneering role worldwide in this regard.
The in-house quota for DACH companies successfully brought to the US is over 90%.
Arms are currently of the utmost interest. However, it is not that easy to enter this market. Anyone attempting to enter the US market in collaboration with a German arms giant such as Thyssenkrupp, for example, would be better off not even trying. The circle of German arms manufacturers is secretive and closed; it is impossible to get in.
However, we know ways to successfully bring our dual-use hidden champions into the US defense industry. Decades of practical experience have taught us these shortcuts, which we are happy to share with our clients.
