Expertise

Restructuring & Insolvency

In distressed situations, speed and sequence decide value. Hesitation is the expensive option.

We work across the full spectrum of an insolvency or distressed situation, representing whichever side of the table a client sits on. That experience runs deep in the sectors most exposed to restructuring pressure right now, including energy, oil and gas, mining, retail, financial services, agribusiness, commercial real estate and healthcare.

Corporate clients trust us to guide both out-of-court financial and operational restructurings and formal court proceedings under Chapter 11. We represent sponsors and strategic or financial investors on the same range of matters, secured and unsecured creditors in Chapter 11, 7 and 13 cases of every size, and creditors' committees and equity interests once a case is in Chapter 11.

Our restructuring team advises on the issues that come up again and again for distressed companies: real estate and leasing matters, disputes over the use of cash collateral, debtor-in-possession financing, enterprise and asset valuations, contested confirmation hearings, and the finer points of the Bankruptcy Code and Article 9.

FAQ

Frequently asked questions

We are a foreign creditor of a German company in insolvency. What now?

File your claim with the insolvency administrator within the deadline, in the required form and language. Foreign creditors routinely lose recoveries to formal errors; we handle the filing and represent you in the proceedings.

Is distressed M&A an alternative to insolvency?

Often, yes. A sale out of the crisis, or through an insolvency plan, can preserve more value than liquidation. The window is short; the assessment has to happen early.
